Terms and Conditions

  1. The minimum order is for three months duration. The account anniversary will be: (a) the date that a domain name is activated; or (b) the date of payment of the initial deposit; or (c) the date that the first page(s) are active on the server, whichever occurs first.
  2. Account work will be performed only from a customer-approved written estimate.
  3. New accounts and changes to existing accounts require prepayment of 50% of the written estimate. The balance is due at the time of customer approval for release of the work. No work will be released for public use until the pages are approved by the customer and the balance due has been paid.
  4. Continuing service will be billed prior to the expiration date of that service. Payment must be received prior to the expiration date in order to avoid a lapse in service. Lapsed service may be reinstated only by the payment of the standard account setup fee.
  5. Infothai cannot be responsible for errors in materials provided by the customer. The customer assumes all responsibility for the content of their pages, even if Infothai has assisted in the preparation of such pages. In the event of complaints or problems caused by the pages, the customer agrees to hold Infothai blameless for the contents of the pages.
  6. Infothai will make it's best effort to provide accurate work. In the event that an error is introduced by Infothai, we will promptly correct the error once it has been brought to our attention; Infothai assumes no other responsibility in such a case.
  7. Infothai reserves the right to refuse to publish or to withdraw already-published materials that meet any of the following criteria: (a) are of questionable legality; (b) do not promote a desirable image for Thailand, the monarch, or the Thai people; (c) are deemed offensive or defamatory; or (d) are under official order of withdrawal. In the event that published materials are withdrawn under this clause, no refunds will be paid.
  8. Accounts are provided for the use of a single customer and may not be resold, leased, assigned, sublet, or otherwise transferred for the beneficial use of a third party.
  9. If Infothai registers a domain name on behalf of a customer, or if a customer uses the services or facilities of Infothai to register a domain name, then the customer agrees to be bound by the Uniform Domain-Name Dispute-Resolution Policy and the Domain Name Registration Agreement. These two documents are incorporated by reference into the terms and conditions of Infothai CM Co., Ltd.
  10. Infothai does not warrant that the functions contained in these Web pages or the Internet Web site will meet the client’s requirements or that the operation of the Web pages will be uninterrupted or error-tree. The entire risk as to the quality and performance of the Web pages and Web site is with the client. In no event will Infothai be liable to the client or any third party for any damages including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate Web pages or Web site, even if Infothai has been advised of the possibility of such damages.
  11. The Client represents to Infothai and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks or other artwork furnished to Infothai for inclusion in Web pages are owned by the client or that the client has permission from the rightful owner to use each of these elements and will hold harmless, protect, defend, and indemnify Infothai from any claim or suit arising from the use of such elements furnished by the client.
  12. Infothai owns copyright and title to all assembled work of Web pages produced by Infothai. Upon final payment of this contract all rights owned by Infothai as to the design, graphics, text, and CGI programs developed entirely for The Client in this Web site will be assigned to the client. Rights to photos, graphics and CGI programs that were not owned by Infothai or were previously developed or modified by Infothai are limited to the client’s use only; the products themselves remain the properly of their respective owners.
  13. Infothai hereby reserves the right to add a “designed by” or “powered by” credit at the bottom of each web page.
